No firm booking can be made until both the Booking Form and the deposit or full payment have been received by Chill Out With Us.
The Client shall pay a minimum reservation deposit of 25% of the total holiday price The remaining balance is due 30 days before the day of arrival. If any payment is not made within this time, Chill Out With Us have the right to treat the contract as cancelled and the usual cancellation terms shall apply (see below). Last minute bookings, 30 days or less before arrival date, will be charged the full amount at time of booking.
All properties offered by Chill Out With Us should be booked in advance and all cancellations must be in writing and become effective on the date of receipt.
Cancellation charges are as follows:
i. Receipt of written cancellation received 30 days or more before the rental period will be charged the full amount of the reservation deposit
ii. Receipt of written cancellation received less than 30 days before the rental period will be charged the full amount of the rental. If Chill Out With Us are able to re-let the property for the same period, the cancellation charge will be the reservation deposit.
CLIENT RESPONSIBILITY / SECURITY DEPOSIT
A security deposit of 200 GBP/euro in cash is required upon arrival against property loss or damage. The deposit is refunded to clients upon departure. The Client is responsible for ensuring the property is left in a reasonable condition of cleanliness and in the same condition of repair as upon arrival. Any excessive cleaning, loss or damage to the property will be charged to the Client.
Clients are required to act in a responsible manner at all times and to act with respect towards neighbours, the landlord and employees. Chill Out With Us reserves the right to require any individual to vacate a property for disruptive behaviour, in which case there would be no refund of any rental payment.
NUMBER OF OCCUPANTS
The total number of guests staying at the property may not exceed the number of sleeping places specified in the advertising material or the number entered on the face of this contract. The Landlord and Chill Out With Us reserve the right to refuse entry or evict the entire party if the number of persons occupying a property exceeds the number stipulated in this contract.
EXPENSES PAID LOCALLY AT EXTRA COST
The rental property and any facilities or services expressly included in the written information provided by Chill Out With Us are included in the contract price. Normal use of gas, electricity and water are also included unless otherwise stated in the price list. Any extra items are to be paid to Chill Out With Us upon arrival.
ARRIVAL AND DEPARTURE TIMES
Unless otherwise agreed, Clients should arrive after 4pm on the day of arrival and vacate the property by 11am on the day of departure. An out of hours fee of 20 euro is payable to Chill Out With Us, for arrivals or departures between 9pm and 8am
Chill Out With Us has taken all possible care to ensure the accuracy of all information and descriptions contained in its advertising material at the time prepared, however, nothing in those materials shall be treated as a term or condition of this contract. Chill Out With Us shall not be liable with regard to any difference of opinion as to the condition or quality of the properties, or the surrounding area, nor for temporary defects or stoppages of any utilities.
Should any problem occur with the property, the Tenant must immediately notify Chill Out With Us. The Tenant should allow Chill Out With Us reasonable time to remedy the problem, or to find a suitable replacement property. Vacating the property without Chill Out With Us authorization does not constitute an adequate cause for a refund. The Tenant is responsible for informing Chill Out With Us of any complaint and allowing a reasonable opportunity to remedy the problem during the rental period; failure to do so will void any claim following the rental period.
It is inevitable that most resorts will expand and building work is occasionally unavoidable. Local authorities may grant permission to build/alter properties and roads without notice. Unfortunately such events are beyond our control. However, if we are made aware of the situation and we consider it will significantly affect your holiday, we will advise you where possible.
CHANGES OR CANCELLATION BY OWNER/CHILL OUT WITH US
Chill Out With Us reserves the right to modify or cancel this contract at any time where it is necessary to do so as a result of natural forces, or any other occurrence outside the control of Chill Out With Us. In the event of any change or cancellation by the Landlord, Chill Out With Us shall inform the client promptly and shall endeavour to offer the Client an alternative property. The Client will have a choice of accepting the substitute property and paying or receiving the difference in rate for the new property, or Chill Out With Us or the Landlord will refund all monies paid. In the event of changes or complete cancellation, liability will be limited to the refund of all monies paid to Chill Out With Us or the Landlord. In no event will Chill Out With Us be responsible for any consequential or incidental damages, including travel expense, alternative lodging, or other expense.
The Tenant acknowledges that Chill Out With Us does not own any rental accommodations and undertakes only to act as agent for the owner of the property. As such, Chill Out With Us shall not be responsible or liable for any death, accident, loss, damage, injury, or inconvenience arising from the rental. Chill Out With Us cannot accept any liability due to parental negligence. All claims are acknowledged to be solely between the client and owner. Chill Out With Us does not accept liability for any loss or damage caused by weather conditions, riot, strikes, sickness or any cause beyond its control.
If any discrepancy is to arise regarding the interpretation or application of this document, all parties agree to renounce the jurisdiction that may correspond to them in favour of the Courts and Tribunals of Almeria and its hierarchies.
